Businesses now need to be aware that they may be held liable for subcontractors and/or franchisees breaches of employment law. 


If it is brought to the attention of a business that the subcontractor/franchisee is not providing the correct minimum terms and conditions of employment to its employees, the business must notify the subcontractor/franchisee of this contravention.


To mitigate any possible liability business should implement appropriate measures to assess the franchisee or subcontractor’s operations (for example, auditing) particularly around compliance with terms and conditions of employment.
